1. Welcome & Agreement
Welcome to Wellnest! We are BITROVA LABS LTD, and we built Wellnest to help you stay connected with your closest family and friends while tracking your daily wellbeing.
By downloading, accessing, or using the Wellnest app, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our app. We know legal documents can be dense, so we have done our best to write these terms in plain, clear language. 2. About Our Service
Wellnest is a social wellbeing companion. The app builds a daily rhythm score based on your movement, rest, mindfulness, a short mood check-in, and how you stay in touch with others. We summarize this information and share it exclusively with the specific circles you choose to join. Within these circles, you can post moments, react, comment, send nudges, and run challenges.
Important Medical Disclaimer: Wellnest is designed to encourage healthy habits and social connection. It is not a medical device. We do not provide medical advice, diagnosis, or treatment. Your daily rhythm score is for informational and motivational purposes only. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
3. Your Account
To use Wellnest, you need to set up an account. Because of the nature of the data we process and the laws protecting children online, you must be at least 13 years old to create an account.
When you register, you agree to provide accurate information and to keep your account credentials secure. We use Firebase Authentication (provided by Google), Sign in with Apple, and Google Sign-In to help keep your login process safe and seamless. You are responsible for all activity that occurs under your account. If you suspect someone else has gained access to your account, please notify us immediately.
You have total control over your presence on Wellnest. You can delete your account directly from within the app at any time.
4. Acceptable Use
Wellnest is built on trust and intimacy. Because you are sharing personal wellbeing data with family and friends, we strictly enforce our community rules.
- When using Wellnest, you agree to keep it kind. You may not:
- Post or share any content that is abusive, hateful, harassing, or sexually explicit.
- Share, screenshot, or distribute another member's health information, rhythm score, or personal moments outside of your shared circle.
- Use the app to spam others or distribute malware.
- Attempt to reverse engineer, hack, or disrupt the Wellnest app or its servers.
If you violate these rules, we reserve the right to suspend or permanently terminate your account to protect the safety and privacy of our community. If you see someone breaking these rules, please report it in the app or to us at support@usewellnest.com.
5. Content & Intellectual Property
Your Content: You retain full ownership of the moments, comments, and data you post to Wellnest. By sharing content in the app, you grant BITROVA LABS LTD a worldwide, royalty-free license to host, store, and display that content solely for the purpose of operating the app and showing it to your chosen circles.
Our Property: BITROVA LABS LTD owns the Wellnest app, including its design, code, logos, and the algorithm used to calculate your daily rhythm score. You may not copy, modify, or distribute our intellectual property without our written permission.
6. Payments, Subscriptions & Billing
Free features. Downloading Wellnest, joining circles and challenges, check-ins, Moments, and nudges are free.
Wellnest Plus. Wellnest Plus is an optional auto-renewing subscription that unlocks extra features, such as starting more circles, longer insights, and the full Mind library. It is offered as a monthly or an annual plan. The price, billing period, and any free trial are shown in the app before you confirm the purchase, in your local currency.
Billing by the app stores. Payment is charged to your Apple ID account on iPhone or your Google Play account on Android when you confirm the purchase. We never see or store your card details.
Automatic renewal. Your subscription renews automatically at the end of each billing period unless you turn off auto-renew at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the end of the current period, at the then-current price.
Free trials. Where a plan includes a free trial, it is available to eligible new subscribers only. If you do not cancel at least 24 hours before the trial ends, the trial converts into a paid subscription and you are charged. Any unused portion of a free trial ends when you purchase a subscription.
Managing and cancelling. You can manage or cancel your subscription at any time in your App Store account settings on iPhone or in Google Play subscriptions on Android. Cancelling stops future renewals; you keep Wellnest Plus until the end of the period you have already paid for. Deleting your Wellnest account or the app does not cancel your subscription.
Refunds. Purchases are processed by Apple or Google, so refund requests are handled under their policies. On iPhone, request a refund through Apple's "Report a Problem" page; on Android, through Google Play. Nothing in these terms limits any refund rights you have under the consumer laws of your country.
Family Sharing. Where the App Store offers Family Sharing for Wellnest Plus, members of your family group may use the subscription under Apple's Family Sharing terms.
Price changes. If we change the price of Wellnest Plus, we will give you notice as required by the App Store, Google Play, and applicable law, and you can cancel before the new price applies.
7. Privacy
Your privacy is fundamental to Wellnest. Because we handle sensitive information like your mood and daily rhythm, we take data protection seriously. We comply with global privacy frameworks including the GDPR, UK GDPR, CCPA/CPRA, and PIPEDA. We do not sell or share your personal information with third-party advertisers.
We integrate with Apple HealthKit on iPhone and Health Connect on Android to securely read movement and rest data for your rhythm score, and we use the Apple Push Notification service and Firebase Cloud Messaging to send you nudges and updates. 8. Disclaimers & Limitations
We work hard to make Wellnest a reliable and helpful companion, but we provide the service on an "as is" and "as available" basis. We do not guarantee that the app will always be error-free, secure, or operate without interruptions.
To the fullest extent permitted by law, BITROVA LABS LTD disclaims all warranties, whether express or implied. In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount you have paid for Wellnest Plus in the last twelve months, or fifty US dollars ($50), whichever is greater. Some jurisdictions do not allow the exclusion of certain warranties or liability limits, so these limitations will apply to you only to the extent permitted by your local laws.
9. Dispute Resolution
If you have an issue with Wellnest, please contact us first at support@usewellnest.com. We want to fix it.
If we cannot resolve the dispute informally within 60 days, you and BITROVA LABS LTD agree to resolve any claims through final and binding arbitration, rather than in court. You may, however, assert claims in small claims court if your claims qualify. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
10. Changes & Termination
We may update these Terms of Service from time to time to reflect changes in our app or legal requirements. When we make significant changes, we will notify you via an in-app notification or by updating the "Last Updated" date at the top of this page. Continuing to use Wellnest after those changes become effective means you accept the new terms.
You can terminate this agreement at any time by deleting your account in the app and removing Wellnest from your device. If you have Wellnest Plus, remember to cancel it in your App Store or Google Play settings as well. We may also terminate or suspend your access to the app if you violate these terms or if we decide to discontinue the service.
11. General Legal
These terms are governed by the laws of the jurisdiction where BITROVA LABS LTD is legally established, without regard to conflict of law principles. If any provision of these terms is found to be unenforceable or invalid by a court, that specific provision will be limited or eliminated to the minimum extent necessary, and the rest of the terms will remain in full force and effect. These terms constitute the entire agreement between you and BITROVA LABS LTD regarding Wellnest. You may not assign your rights under these terms without our consent, but we may assign our rights freely.

13. Confidentiality
In the course of using our services, especially if you are interacting with us in a business or partnership capacity, both parties may share non-public, confidential information. Both you and BITROVA LABS LTD agree to protect each other's confidential information with the same degree of care used to protect our own. This obligation does not apply to information that is already public, was independently developed, or is required to be disclosed by law.
14. Indemnification
We believe in mutual fairness. You agree to indemnify and hold BITROVA LABS LTD harmless from any claims, damages, or legal fees arising from the content you upload, your violation of these terms, or your misuse of the Wellnest app.
In return, BITROVA LABS LTD agrees to indemnify and hold you harmless from any third-party claims alleging that the Wellnest app itself (excluding your user-generated content) infringes upon their intellectual property rights.
15. Service Levels
While we strive to keep Wellnest running smoothly 24/7, we do not currently offer a guaranteed uptime commitment or service level agreement (SLA). The app is provided without service credits for downtime. If the app experiences an outage, we will work diligently to restore service as quickly as possible.
16. Force Majeure
Neither you nor BITROVA LABS LTD will be held liable for any delay or failure to perform any obligation under these terms if the failure is caused by events beyond our reasonable control. This includes, but is not limited to, acts of God, natural disasters, war, terrorism, labor disputes, or widespread internet or telecommunications outages.
17. Beta and Preview Features
From time to time, we may release new features labeled as "beta," "preview," or "experimental." These features are provided entirely "as is" so we can test them and gather your feedback. They may contain bugs, may not work as intended, and can be changed or withdrawn by us at any time without notice. They are excluded from any standard service commitments.
18. Order of Precedence
While Wellnest is primarily a consumer application, if you are a partner or enterprise customer who has signed a separate Master Services Agreement (MSA), Data Processing Agreement (DPA), or Order Form with BITROVA LABS LTD, those specific documents will take precedence over these Terms of Service in the event of any direct conflict.
19. Arbitration Opt-Out
If you do not wish to be bound by the binding arbitration and class action waiver detailed in Section 9, you have the right to opt out. You must notify us in writing at support@usewellnest.com within 30 days of creating your Wellnest account. Your notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration.
Savings Clause: If the class-action waiver is found to be unenforceable by a court of competent jurisdiction, then the entirety of the arbitration agreement will be deemed void as to that specific claim, and that claim must be litigated in court.
20. Data Export and Deletion on Termination
When you choose to leave Wellnest, you have the right to take your data with you. Upon terminating your account, you have a 30-day window to request an export of your personal data (such as your moments and rhythm history) in a standard, readable format. You can request this export by emailing support@usewellnest.com.
Once this 30-day window expires, or if you trigger an immediate permanent deletion directly within the app settings, your data will be permanently and irreversibly deleted from our active servers, subject only to routine backup cycles which are purged automatically.
